HiP CARAVANS TERMS AND CONDITIONS

DEFINITIONS

‘This agreement’ means rental agreement and the following terms and conditions will apply to all areas.
 
‘CUSTOMER’ means the hiree or the hirer of the vehicle and is the person or persons nominated as drivers of the tow vehicle.
 
‘HIP’ means - HiP Caravans.
 
‘RENTAL PERIOD’ means the agreed hire period between the customer and HIP.
 
‘PAYMENTS’ means any moneys due before and during the agreed hire period including deposits, bonds and excess insurance.
 
‘VEHICLE’ means caravan, motorhome or camper trailer.
 

1. CUSTOMER REQUIREMENTS

1.1 Any persons named as the customer shall be fully responsible for the security of any HIP vehicles including all equipment and agree to keep the vehicle cleaned and maintained during the hire period.
1.2 The customer must be over the age of 25 and under 75 and hold a full Australian driver’s license or a valid international driver’s license with no previous driving convictions or have been refused insurance at any time.
1.3 The customers towing vehicle must be registered and covered by fully comprehensive insurance throughout the rental period. Proof of this is needed prior to the booking being confirmed.
1.4 HIP requires 2 forms of ID for each customer chosen from the following list: Current photo driver’s license for any nominated customer; a credit card or Medicare card; or recent rates bill.
1.5 The customers agree the vehicle is the sole property of HIP and shall not lend, sell or sub-let out any property of HIP including any equipment.
1.6 Customers are required to follow the vehicle instructions as laid down by HIP, and are required to demonstrate the correct procedures for set up and put down of the vehicle, before leaving the pick- up point.
1.7 HIP reserves the right to cancel the agreement with no refund if the customers towing vehicle is deemed unsuitable.
1.8 Lost property of the customers will be kept by HiP for the period of one week – after such time if the items have not been claimed – items will be donated to charity. Customers are responsible for contacting HiP during the week following the hire. If the customer wishes for items to be posted – customers will be responsible for the cost of the postage associated in its return.
 

2. TERMS OF PAYMENT

2.1 A deposit of 30% is required at the time of booking to secure the vehicle with the balance payable no less than 30 days prior to vehicle pickup.
2.2 A security bond of $1000 is also required 5 days prior to pick up and is fully refundable as per clause 3 of the terms or payment.
2.3 The vehicle must be delivered back on time in the same condition as it was on the day of hiring. The security bond and excess insurance payment will be paid back in full or part within seven days depending on any damage or missing items that need to be accounted for but disregarding normal wear and tear.
2.4 Cancellations terms are as follows:
(4A) - Cancelling the booking over 90 days prior to pick up – An administration fee of $150 will apply to the cancellation of all bookings.
(4B) – Cancelling the booking over and including 30 days prior to pick up - 50% of gross rental fee.
(4C) - Cancelling the booking up to 29 days prior to pick up – 100% of gross rental fee.
(4D) – Cancelling due to Extenuating Circumstances – e.g. Natural disasters, Terrorist activity, Civil & Political unrest, Event Cancellation, Epidemic Disease or Illness, Government mandated obligations (travel restrictions), Clauses 4A, 4B & 4C listed above will still apply.  
2.5 All prices are inclusive of GST
2.6 Merchant Fees of + 1.75% will be added total hire amount if paying via creditor debt cards
 

3 CLEANING/MAINTENENCE

3.1 It is the responsibility of the customer to return the vehicle in the same condition inside and out as the first day hire. HIP supplies adequate cleaning equipment to ensure the vans can be cleaned upon return. There is a service fee of $99 on all caravan hires to cover consumable products. Excessive cleaning required from HIP will result in an additional cleaning fee taken from the bond at $77 per hour, ($250 maximum). In applicable vehicles, the toilet must be emptied before return and the fridge, microwave and stove cleaned.
3.2 During a hire period of more than 2 weeks it may be necessary to clean the front of the van from bug and road grime with the hose and brush supplied. Do not use any cleaning products that can harm the outside of the vehicle. (Do not use pressure hose at any time)
3.3 If the caravan is returned with camp fire smoke scent through the van there will be a fee of $99 applied
3.4 The Toilet cassette needs to be emptied & cleaned on return, if not there will be a $99 cleaning fee applied
3.5 Please ensure all equipment is stowed in their correct manner with the covers supplied.
3.6 The customer is responsible for checking wheel nuts and tyre treads on a regular basis and wheel nuts should be tightened every 1000 kilometres.
 

4 ACCIDENT/DAMAGE

4.1 In the event of an accident the customer must obtain the registration number of the other vehicles, names and addresses, insurance details, driver’s license details, contact numbers of third parties and any witnesses. The customer must then contact the police and fill in a full report and contact HIP immediately. Do not move the vehicle if it is unsafe.
4.2 The customer must report to the police any theft, accident or damage of any HIP property caused by a third party during the hire period, and contact HIP immediately.
4.3 In the case of a breakdown, the liability is that of the customer and it is the customer’s responsibility to ensure that the vehicle and its equipment are safe and secure.
4.4 The customer shall not be liable for normal wear and tear but will be liable for any damage caused including missing, lost or replaced items, all of which will be deducted from the bond.
4.5 In a case where the amount of damage or replacement cost exceeds the bond already held by HIP, the customer shall be responsible for paying any additional amounts which will be charged against the credit card number as supplied for the bond.
4.6 The customer agrees that HIP shall not be responsible for the customer, or in any way be liable for any costs, thefts, personal or property damages, or claims from the customer. HIP also recommend the customer takes out their own travel insurance.
4.7 Do not leave the Awning out in windy and or wet conditions, or whilst unattended as awnings and annexes are not covered by insurance and shall be the responsibility of the customer.  All damage and costs during the hire period shall be covered by the customer.
4.8 The customer is responsible for replacing punctured, blown or shredded tyres at their own expense and must replace with the same make and model (i.e. no re-tread).
4.9 Please ensure that all drawers and cupboards are secure and that no Items are left on the interior floor whilst travelling, as this may cause damage. If applicable make sure TV is secure or is packed safely away.
4.10 HiP will not be responsible nor liable for costs associated with alternative accommodation sort due to any unforeseen circumstances that may arise during the booking period with the repair of the vehicle if required.
4.11 In the event of potential issue with the vehicle hired or part thereof, HiP Administration is to be notified as soon as practical. HiP Administration will advise the best course of action to
rectify the situation. I agree to consult and negotiate with HiP Administration and conduct the actions necessary.
4.12 If the affected vehicle or part thereof is deemed to be essential to functioning of the vehicle, then arrangements will be made for the immediate repair to the vehicle. If the issue is deemed to be not essential - repairs will be conducted upon the vehicles return.
 

5 TOWING RULES AND RESTRICTIONS

5.1 HIP vehicles are not permitted on unsealed roads other than dirt roads to access certain camping grounds and national parks. HIP vehicles are not permitted to travel over rocky roads, swollen creeks, rivers or beaches and are not permitted on any marked 4WD roads. Any damage caused by travelling on unsealed roads will be fully incurred by the customer.
5.2 All vehicles are non-smoking and do not allow pets inside the interior.
5.3 The customer must at all-time drive with due care and attention within the guidelines of each States road rules and regulations, including, not at any time driving under the influence of alcohol or drugs.
5.4 Before travelling, the customer must ensure that all exterior vehicle lights are connected and are working and that all safety chains and towing apparatuses are correctly assembled.
5.5 Before travelling, the customer must ensure that all electric leads and hoses are disconnected and that all stabilizer legs are retracted and that the jockey wheel is removed and stored.
5.6 It is the responsibility of the customer to ensure that the towing vehicle complies with the tow bar specifications and regulations set for the hired vehicle.
5.7 Customers must have a 50mm tow ball installed to the towing vehicle.
5.8 It is the responsibility of the customer not to overload the hired vehicle and in the event that this occurs, that it is at the customers own risk and liability.
5.9 It is the responsibility of the customer to pay any traffic infringements including speeding and parking fines, tolls etc.
5.10 HIP vans have different types of braking systems for different sized vans, please see individual caravan specifications.
5.11 When unattended and unhitched the customer must connect a coupling lock which can be supplied by HIP on request.
5.12 The TV reception is affected by the environment & surrounds, in some locations you may not pickup a tv signal, even within caravan parks. The caravans are mobile units & signal strength can vary from site to site.  
5.13 Filling of the water tanks is the responsibility of the customer prior to traveling
 

6. RENTAL PERIOD

6.1 Rental days are calculated on a calendar day basis. The pick-up day is counted as the first rental day and the return day of the vehicle is counted as the final rental day, regardless of pickup or drop off time.
6.2 Minimum rental is 4 calendar days (Off Peak) & 7/14 calendar days (Peak) this is subject to availability and depending on times of the year.
6.3 Drop off points and return points are confirmed at the time of booking and any potential changes will only be accepted at the discretion of HIP, and if so, then this may incur extra fees.
6.4 Late pick-up or early return does not entitle the customer to any refund.
6.5 The drop off time for return date is 12noon. The late return of a vehicle will be charged at double the daily rate per day as per the agreement and may result in the loss of any bond if another hire is jeopardized.
 

7. THIS AGREEMENT

7.1 This Agreement constitutes the entire agreement between HIP Caravans and the customer and no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this Agreement.
7.2 HiP Caravans reserves the right to refuse, terminate any hire agreement at any time without notice if they feel their asset is at risk.
